Terms of Service
This translation is provided for convenience only. The Hebrew text is the binding version.
These terms govern the use of the Regaim site and the engagement between us and anyone who orders a film through it. Placing an order constitutes acceptance of the terms set out here, of the Cancellations & Refunds policy and of the Privacy Policy. The Hebrew original is written in the masculine form for convenience only and is addressed to all genders.
General — the site’s operators
The “Regaim” site is operated by [Trader / company name], business / company number [Business / company number]. “Regaim” is a trade name; the engagement is with the trader named above.
[To be completed: the full legal name of the sole trader or company, the registered dealer or company number and the business address — filled in once in the site settings (the footer) and shown here automatically. The Consumer Protection Law requires these details to be displayed, and the site must not be published without them.]To contact the site’s operators: WhatsApp 052-400-0820.
Ordering on the site is for adults (18 and over). A minor who would like a film orders it through a parent or guardian, who is the party to the engagement.
The service and the packages
We produce short animated films from photographs the customer uploads. The film is produced by hand, by us, and is not an automated output. The service offered is The Memories Film, and these are the packages on offer:
- The Short Film — a 90-second film, up to 15 photographs, ₪149.
- The Full Film — a 180-second film, up to 30 photographs, ₪249.
All the packages include the same components; they differ only in the length of the film, the number of photographs and the price. Every package includes:
- Smooth transitions between the photos
- Text on the photos
- A personal greeting
- Music from a licensed library
- One round of corrections
There is no separate charge for the components above — they are part of the package price. These are the add-ons that can be added to an order for a separate charge:
- Delivery within 24 hours — ₪79.
The prices shown on the site are the final consumer prices and include VAT where it applies. A promotional price is shown beside the full price, and what you pay is the amount shown in the order summary before payment.
The preview on the site — the film that plays in the studio before you order — is an illustration of the photo order, pace, captions and music you chose. The finished film is edited by hand according to those choices, so the details of the transitions, the exact timing, the cropping and the animation may differ from the preview. The order is for a film edited to your choices, not for an exact copy of the preview.
Rights in the photographs you upload
By uploading the photographs you declare and undertake that you own the rights in them or hold lawful permission to use them, and that you have the consent of every person appearing in the photographs to their use in producing the film. It is your responsibility to obtain the consent of a parent or guardian where minors appear in the photographs.
The photographs remain yours. We receive a limited licence in them, for producing your film only, and will not use them for any other purpose — not in advertising, not in a portfolio and not for training systems — except with your separate, explicit, written consent (see the Privacy Policy).
We do not check, and cannot check, the origin of the photographs. Do not upload photographs that infringe the rights, privacy or dignity of others, or offensive or unlawful content. If we suspect such a photograph has been uploaded, we may pause production, ask for clarification, or cancel the order under the Cancellations & Refunds policy.
If it turns out that the declaration above was not true — that the rights or consents were not yours to give — the responsibility is yours alone. You undertake to indemnify us for any damage, expense, demand or claim by a third party (including reasonable legal costs) caused to us as a result, and to work with us in resolving any such demand. We will notify you of such a demand promptly and will not settle it in your name without asking you.
Rights in the finished film
Once payment is complete and the film is delivered, the finished film is yours. You may watch it, keep it, copy it, screen it and share it — with family, with friends, at the event and on social networks — for personal and family use, with no time limit and no limit on views. We ask for no credit.
The generic components used in producing it — templates, animations, transitions, fonts and our editing tools — remain ours or their creators’, and your licence in them is for use within your film only. The film may not be sold, rented, taken apart into its components or used for commercial advertising or the promotion of a business without our written consent; we will gladly grant such a request, usually free of charge.
The music in the film consists of works and recordings in the public domain (CC0), so you may distribute the film with its music on any channel — social networks included — without a further licence and with no attribution owed. If a social network mistakenly flags the music as protected, we will provide you, on request, with the source details and the licence confirmation.
We will not show your film or use it for any purpose — including as an example on the site — except with your separate, explicit, written consent, which you may withdraw at any time.
Delivery times
The standard delivery time is 4 business days (Sunday to Thursday, excluding holidays). For an order purchased with the “Delivery within 24 hours” add-on, the delivery time is 24 hours. The clock starts from the moment the order is complete — payment approved and all the photographs received by us. When ordering through the studio the two happen together; when ordering through the order form, where the photographs are uploaded after payment, the clock starts when the photographs are uploaded. Change requests or photographs replaced during production may extend the date accordingly.
The film is delivered by a personal link sent to the e-mail address you provided. The link is valid for 30 days. The site has no user accounts, so keep the link and download the film to your device within that period. Link expired? As long as the film is still stored with us — up to 90 days from delivery — we will issue you a new link free of charge, on request by e-mail from the address the order was placed from. After that period the files are deleted and we cannot recover the film, so keep a copy of your own.
If we missed the delivery date we committed to: on an order with the “Delivery within 24 hours” add-on, the surcharge for it is refunded to you in full, even if the film arrives only hours late. On any order, a delay in delivery not caused by you entitles you to cancel the transaction and receive a full refund within 14 days of the cancellation notice, with no cancellation fee, as provided in section 14E(a) of the Consumer Protection Law, 5741-1981 — and you may, of course, choose to wait for the film instead.
Force majeure: if an event beyond our control — a state of emergency, a disruption at a third-party service we rely on, illness — prevents us from meeting the date, we will let you know promptly and offer a new date. If the new date does not suit you, you may cancel and receive a full refund.
Payment
Payment is made on the site, in full, when the order is placed, through an external payment processor (Grow). Credit card details are passed directly to the payment processor and are not stored by us. The order confirmation, and later the receipt or invoice, are sent to the e-mail address you provided. Further details are on the Privacy Policy page.
Cancelling a transaction
The terms of cancellation, refunds and the round of corrections are set out on the Cancellations & Refunds page, and they form an integral part of these terms. The rights under the Consumer Protection Law, 5741-1981, and the regulations made under it apply in addition to the above, and nothing in these terms is intended to detract from them.
Liability
We undertake to produce the film with skill and in good faith, according to the choices you made and by the date we committed to, and to correct it within the included round of corrections. If the film delivered does not match the order, you are entitled to a correction or a full refund, as set out in the Cancellations & Refunds policy.
We are not an archive. The photographs and the film are kept with us for a limited period (see the Privacy Policy) and are deleted at its end. Keep your original photographs and the film you downloaded; we cannot recover files once they have been deleted.
Our liability towards you in any matter connected with the order is limited to the amount you paid for it, and we will not be liable for indirect or consequential loss, except where the law does not allow liability to be limited — for example for damage caused wilfully or by gross negligence, or the rights granted to you by the Consumer Protection Law and the Privacy Protection Law, which cannot be contracted out of.
Governing law and jurisdiction
These terms and the engagement are governed by Israeli law. Jurisdiction lies with the competent courts of Israel under the ordinary rules of jurisdiction, and nothing in this clause denies you the right to bring a small claim in the court nearest your home. Before any proceedings, we will gladly try to resolve any dispute directly.
Changes to these terms
We may update these terms from time to time. A material change will be published on this page at least 7 days before it takes effect, and customers with an open order will be notified by e-mail. Every order is governed by the version in force when it was placed, and the date of the last update appears below.
